The Mental Capacity Act (& DoLS 2007) & Mental Health Act
It has been highlighted and reported nationally that there is a need for training and increased understanding in respect of these essential pieces of legislation, which relate significantly to all health, social and voluntary care and support service provisions.
This open course aims to give staff greater confidence in understanding the legislation, changes and proposed updates and to give a clear understanding of their responsibilities and accountabilities.
The course will also include:
To refresh both Acts (including terminology such as ADRTs, LPAs, Deputies, OPG, Sections, CTOs, 117s etc.)
The key principles of the MCA and MHA, including their differing implications
To know when and how to test for capacity and when to refer on using the correct pathway(s)
To discuss fully when and how to refer for authorisations
Documentation in relation to: choice, capacity, restrictions and Duty of Care
Discussion and reflection as to the practicalities of applying this legislation in the workplace.
